JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 14.7.2017 passed in Cr.Misc.No. 32392 of 2017 on merit with a direction to learned trial court to expedite the trial and try to conclude it within a period of five months and if not, petitioner was given liberty to renew his prayer for bail.
Submission of learned counsel for the petitioner is that period of five months has already expired and trial has not been concluded as yet.
Heard learned APP also and perused the report from which it appears that the case is at the stage of argument and if accused persons co-operate, the trial will be concluded within two months.
Patna High Court Cr.Misc. No.6130 of 2018 (3) dt.07-03-2018 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. Hence, prayer for bail is rejected.
However, learned trial court is directed to expedite the argument and conclude the trial within a further period of two months from the receipt of this order. At the same time, petitioner is directed to co-operate in conclusion of trial. Accordingly, this application is dismissed.
