ANJANA MISHRA ORAL ORDER 16-10-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 08.08.2019 in connection with Sahebganj P.S. Case No. 340 of 2019 registered for the offence under Sections 272 and 273 of the Indian Penal Code and Sections 30(a), 36 and 38 of the Bihar prohibition and Excise Act.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but from underground of the door step of the petitioner which is in joint possession of others. The petitioner has no criminal antecedent.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC.
