JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-02-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was twice rejected by this court taking note of this fact that on the basis of confessional statement of this petitioner, the skeleton as well as clothes of the victim of the present case were recovered but submission on behalf of the petitioner is that in course of investigation, petitioner and two others were arrested and para 84 of the case diary goes to show that the so-called recovery was made on the basis of joint confessional statements of petitioner and two others. Learned counsel for the petitioner further submits that co-accused, Nandan Kumar Singh and Shudhir Kumar Singh

Patna High Court Cr.Misc. No.7586 of 2018 (3) dt.28-02-2018 2/2 @ Sadhu have already been granted bail by a co-ordinate Bench of this court and para 84 of the case diary reveals that so-called confessional statement of the petitioner was recorded jointly along with above stated co-accused Nandan Kumar Singh and Shudhir Kumar Singh @ Sadhu.

The trial court has reported that up till now, only six prosecution witnesses could be examined and it is submitted that altogether 12 witnesses have been shown in charge sheet. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Presiding Officer, F.T.C.-II, Sitamarhi in connection with Sessions Trial No. 243 of 2016/267 of 2017 arising out of Majorganj P.S. Case No. 256 of 2015.
