2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302 and 34 of the Indian Penal Code.
3. Allegation against the petitioner along with other co-accused persons is that they assaulted the father-in-law of the informant due to which he sustained injuries and later on he died in the way to hospital.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. There is case and counter case between the parties and both parties have sustained injuries as alleged in separate occurrence. Nothing specific allegation
Patna High Court CR. MISC. No.74377 of 2023(3) dt.05-01-2024 2/2 has been levelled against the petitioner rather general and omnibus allegation has been attributed against all the accused persons including this petitioner. Moreover, he is languishing in judicial custody since 17.07.2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bajpatti P.S. Case No. 85 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri, Sitarmarhi.
