JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-09-2021 Heard learned counsel for the petitioner, learned counsel appearing on behalf of O.P. Nos. 2 and 3 and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Complaint Case No. C.R. No. 1930 of 2017 (T.R. No. 2879 of 2019) for the offence under Section 323 and 498(A)/34 of the Indian Penal Code.

Sri Choudhary Shyam Nandal, Learned counsel appearing on behalf of petitioner submits that in compliance of

Patna High Court CR. MISC. No.64143 of 2019(5) dt.13-09-2021 2/3 order dated 04.03.2020, petitioner Anil Jha and O.P. No.3 Puja Kumari @ Puja Devi, who are husband and wife, are residing together at the house of petitioner. Further submission is that petitioner will keep his wife (O.P. No.3), in future also, with full dignity.

On the other hand, Sri Alok Kumar Sinha, learned counsel appearing on behalf of O.P. No.2&3 submits that at present, O.P. No.3 Puja Kumari, wife of petitioner, used to reside at her matrimonial house with the petitioner. Having regard to the facts and circumstances of the case and the submissions of learned counsel for the petitioner and O.P. Nos.2&3 that the petitioner and O.P. No.3 are residing together at the house of petitioner and also taking into consideration the submission of petitioner that he will keep his wife (O.P. No.3) with full dignity, in future, let the petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Mr. Rakesh Kumar, Judicial Magistrate, 1st , Samastipur in connection with Complaint Case No. C.R. No. 1930 of 2017 (T.R. No. 2879 of 2019), subject to the condition as laid down
