Petitioner, already in custody, seeks bail in connection with Siwan Muffasil P. S. Case No. 499 of 2017, registered under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) and 41 (1) of the Bihar Prohibition and Excise Act, 2016. The allegation in brief is that 54 liters of illicit foreign liquor was recovered from the auto rickshaw of the petitioner. Learned counsel for the petitioner submits that the alleged recovery of foreign liquor was from the Auto rickshaw but the petitioner was a passenger and the petitioner has no criminal antecedent. However, the petitioner is in custody since 17.10.2017.

No.4932 of 2018 (2) dt.31-01-2018 2/2 Having considered the said facts and circumstances, the petitioner, Brajesh Kumar @ Brijesh Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Special Judge, Siwan in connection with Siwan Muffasil P.S.Case No. 499 of 2017.
