JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 27-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 302, 201, 120(B) of the Indian Penal Code. The prosecution case as per F.I.R is that the petitioner along with other accused persons came at the door of the informant and took away his son. In the next morning, the dead body of his son was found in the water of Balwa Kuari Chaur.
Patna High Court CR. MISC. No.66182 of 2022(2) dt.27-02-2023 2/3 It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is no eye witness to the occurrence. The petitioner has been roped in the present case only on the basis of suspicion and during investigation no material evidence has been found against the petitioner. Moreover, other coaccused persons have been granted bail by a coordinate Bench of this Court vide order dated 28.06.2022. The petitioner is languishing in custody since 15.06.2021. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Vaishali at Hajipur in connection
