Petitioner, already in custody, seeks bail in connection with Raushanganj P.S. Case No.148 of 2017, giving rise to POCSO Case No.13 of 2018, registered under Section 366(A) of the Indian Penal Code as well as under Section 4 of the POCSO Act.

Learned counsel for the petitioner submits that it is a case of elopement and the petitioner has married with the girl as per the desire of the daughter of the informant, which is reflected from her statement recorded under Section 164 Cr.P.C., moreover the girl was found 19 years of age as per the assessment made by the medical board.

Having considered the aforesaid facts and

No.22747 of 2018(2) dt.17-04-2018 2/2 circumstances, petitioner Pintu Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ, 1st, Gaya in connection with Raushanganj P.S. Case No.148 of 2017, giving rise to POCSO Case No.13 of 2018.
