2. The petitioner apprehends his arrest in connection with Garkha P.S. Case No. 520 of 2023 registered for the offences punishable under Sections 147, 148, 149, 341, 354 (B), 323, 307, 504 and later on 302 of the IPC.
3. As per prosecution case, the accused persons including the petitioner assaulted on the head of the informant namely Parvati Devi, who in course of treatment died. Specific allegation of assault is against co-accused Bablu Rai.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the
Patna High Court CR. MISC. No.74698 of 2024(4) dt.09-04-2025 2/3 petitioner. The informant side is the aggressor in the present case. There is case and counter case between the parties. Learned counsel for the petitioner further submits that similarly situated co-accused persons namely Sunil Kumar Ray @ Sunil Rai, Manish Rai, Manai Rai, Bachcha Rai and Pappu Kumar Rai have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 09.04.2024 passed in Cr. Misc. No. 83257 of 2023. Petitioner has one criminal antecedent in which he is on bail. Petitioner undertakes to cooperate in the investigation of the present case.
5. Learned APP opposes the prayer for anticipatory bail of the petitioner.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the concerned Court where the case is pending in connection with Garkha P.S. Case No. 520 of 2023, subject to the conditions as laid down under Section
