The petitioner is in custody in connection with Biraul P.S. Case No.353 of 2017, a case under Sections 272/273/34 of the Indian Penal Code and Sections 30(a)/38(i)/41(i) of the Bihar Prohibition and Excise Act, 2016. Co-accused Tripurari Choudhary @ Pappu Choudhary has already been allowed anticipatory bail by a coordinate Bench of this Court in Cr. Misc. No.1980 of 2018. In the circumstances, there is no reason to refuse the prayer for regular bail to the petitioner.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty

Patna High Court Cr.Misc. No.5073 of 2018 (2) dt.29-01-2018 P2/ Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
