In view of the averments made in the interlocutory application, the defect no. 4 is ignored.

The learned senior counsel for the petitioner has submitted that the dispute has been compromised between the petitioner-husband and the respondent-wife out side the court and now the prayer has been confined only for a direction to the learned court below for early disposal of the Matrimonial Case No. 69 of 2011 for restoration of peace between the parties. Accordingly, this writ application is disposed of with
