Petitioner seeks regular bail in a case registered for the offences punishable under Sections 302,120(B)/34 of the Indian Penal Code and Sections 27 of the Arms Act.

Submission is that FIR as well as case diary would reveal that there is no eye-witness of murder, however, only suspicion is against the petitioner and other accused for the reason of land dispute. Petitioner is in custody since 27.10.2017. Investigation is complete and only material against the petitioner is suspicion. Considering the entire facts and circumstances of the aforesaid case, let the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 20,000/-(Twenty Thousand) with two sureties of the like amount each to the

Patna High Court Cr.Misc. No.5907 of 2018(3) dt.16-03-2018 2/2 satisfaction of the learned Court below where the case is pending in connection with Morkahi P.S. Case No. 162 of 2017, G.R. No. 3087 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
