The petitioner is in custody in connection with Laukaria P.S. Case No.63 of 1993, a case under Section 364 of the Indian Penal Code, pending in the Court of learned 1st Additional Sessions Judge, Bagaha (Bettiah).

In view of observation in the impugned order, dated 05.12.2016, passed by the learned Court-below in Sessions Trial No.303 of 2007 whereby the learned Court-below directed framing of the charge and disposal of the case on priority basis and accordingly rejected the prayer for bail without discussing the merit of the case, the petitioner may renew the prayer before the Court-

Patna High Court Cr.Misc. No.3836 of 2018 (5) dt.12-04-2018 2/2 below who shall pass a reasoned order in the light of order dated 05.012.2016.

With the aforesaid observation, this application stands disposed of.
