The petitioner apprehends his arrest in a case registered for the offence under Sections 399/402/414 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act. On a secret informant that some miscreants have assembled to commit a crime, a raid was conducted and two coaccused persons were apprehended on spot with arms and ammunition, who disclosed the name of this petitioner, as one of the person who fled away from the place of occurrence. It is submitted on behalf of petitioner that no incriminating article has been recovered from the possession of the petitioner and only on the basis of confessional statement of apprehended co-accused persons, he (petitioner) has been made accused in this case. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.68249 of 2022(3) dt.11-05-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S.
