The petitioner seeks bail in a case registered for the offence punishable under Section 393 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that the accused persons committed broad day robbery and in course of that, firing was made and the informant was injured by the criminals. Learned counsel for the petitioner submits that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 24.06.2019. Charge sheet has already been submitted. There is no recovery of any incriminating articles from the possession of the petitioner. The

Merely on the basis of secret information, the petitioner has been made accused in this case. The source and genuineness of the secret information has not been disclosed by the prosecution. The co-accused Amrik Sahni @ Amrit Sahni has been granted bail by the Co-ordinate Bench of this Hon'ble Court in Cr. Misc. No. 32248 of 2019 dated 16.05.2019.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Madhubani, in connection with Pandaul P.S. Case No. 198 of 2017 (CRI Case No. 2297/2017).
