1. Heard learned counsel for the parties.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Guraru P.S. Case no. 41 of 2024 registered under section 392 of the Indian Penal Code.

3. As per the prosecution case, the informant states that while he was going in front of the school talking on his mobile phone, two accused persons on a motorcycle snatched his mobile phone and escaped.

4. Learned counsel for the petitioner submits that the earlier prayer for bail of the petitioner was rejected vide order dated 3.6.2024 (Annexure-1) passed in Cr. Misc. no. 39548 of 2024 giving liberty to the petitioner to renew his prayer for bail after completing six months in custody. It is submitted that the F.I.R. was registered against unknown. The petitioner was falsely implicated in the case in course of investigation.

Patna High Court CR. MISC. No.74933 of 2024(2) dt.29-10-2024 2/2 Contrary to the allegations, no incriminating article has been recovered from his possession. The petitioner has remained in custody since 18.3.2024.

5. The application for bail is opposed by learned A.P.P. for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the observation given in the earlier order of rejection dated 3.6.2024 and the petitioner having remained in custody for more than 7 months since 18.3.2024, the petitioner is directed to be enlarged on bail in connection with Guraru P.S. Case no. 41 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-X, Gaya.
