====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-02-2024 Heard learned counsel for the petitioner and Mr. Bhanu Pratap Singh, learned A.P.P. for the State.
2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 324, 342, 325, 307, 327/34 of the Indian Penal Code.
3. As per the prosecution case, this petitioner along with co-accused Santosh Singh armed with iron rod and khanti assaulted the informant as a result of which informant sustained several injuries.
4. Learned counsel for the petitioner submits that a free fight took place between the parties due to the land dispute in which both sides sustained injuries. Case and counter case. Instant case has been lodged after delay of four days and there is no explanation for the same.

Considering the delay in lodging the F.I.R. and backdrop of the case in which the occurrence took place, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District & Sessions Judge, Sheikhpura in connection with Mehus P. S. Case No. 25 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
