JUSTICE ARUN KUMAR ORAL ORDER 09-04-2018 Heard learned Counsel for the petitioners and the State as also the learned Counsel appearing on behalf of the informant. Petitioners, already in custody since 8.2.2018, seeks bail in Madhepura (Ghailadh O.P.) PS Case No. 61 of 2018 registered under Sections 364, 302, 34 and 201 of the IPC.

The allegation in brief is that the deceased was taken away by one Santosh Kumar to river, where all he FIR named accused persons were present and after killing informant's brother threw the dead body and he was murdered because of having illicit relationship with wife of Bhupendra Tanti.

Learned Counsel for the petitioners submits that the petitioners are not named in the FIR, there is no material against the petitioners, both have been made accused only because petitioners 1 and 2 are brother and father respectively of Bhupendra Tanti and both have no criminal antecedent.

Having considered the said facts and circumstances, the petitioners, namely, Ravindra Tanti and Devdatta Tanti are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Madhepura in connection with Madhepura (Ghailadh O.P.) PS Case No. 61 of 2018.
