2. Learned counsel for the petitioners is permitted to make correction in the main application in course of the day.
3. Heard learned counsel for the petitioners and learned APP for the State.
4. The petitioners apprehend their arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code and Section 3/4 of the D.P. Act.
5. Petitioners are the father-in-law, mother-in-law,
Patna High Court CR. MISC. No.72885 of 2024(5) dt.30-04-2025 2/3 brother-in-law (Bhaisur) and sister-in-law (Gotni) of the opposite party no. 2. The prosecution case is based upon a complaint filed by the opposite party no. 2 in which she has made an allegation of demand of dowry and torture.
6. Learned counsel for the petitioners submits that there is general and omnibus allegation of demand of dowry and torture upon all these petitioners and no specific allegation has been carved out against the present petitioners. It has also been submitted that co-accused Rakesh Ranjan, who is also the husband of the opposite party no. 2, is ready to keep his wife with full dignity and honour.
7. The application has been opposed by the learned APP for the State.
8. In such view of the matter, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bikramganj, Rohtas in connection with Complaint Case No. 28 of 2024, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and subject to the
Patna High Court CR. MISC. No.72885 of 2024(5) dt.30-04-2025 3/3 further condition that the petitioner shall cooperate in the investigation/trial.
