The petitioner seeks bail in connection with Muffasil P.S. Case no. 321 of 2017 registered under Section 30(a) of Bihar Prohibition & Excise Act-2016.
155 lts. of country made liquor is said to have been recovered from Ishwar Choudhary Halt, Manpur being carried by the petitioner and two other ladies who managed to escape. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from her conscious physical possession. Petitioner was neither apprehended on the spot nor has any concern with the aforesaid liquor. Petitioner has been languishing in custody since 12.12.2017. Similarly
Patna High Court Cr.Misc. No.7080 of 2018(2) dt.12-02-2018 2/2 situated co-accused namely, Sabitri Devi and Dulari Devi have been enlarged on bail vide order dated 19.12.2017 passed in Cr. Misc. no. 58591 of 2017 by a co-ordinate Bench of this Court. Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Gaya in connection with Muffasil P.S. Case no. 321 of 2017.
