JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 Petitioner seeks regular bail in connection with Bhabua (Sonhan) P. S. Case No. 830 of 2018, registered for the offences punishable under Sections 366-A/34 of the Indian Penal Code.

As per F.I.R. allegation against the petitioner and one co-accused person of kidnapping the minor daughter of the informant and trying to sell her.

Submission of the learned counsel for the petitioner is that as a matter of fact, she has love affair with the brother-inlaw of the petitioner, and as such, she has fled away. Now the false and concocted case has been lodged against the petitioner. It has also been submitted that girl is aged about 17-19 years. Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that there is allegation of kidnapping against the petitioner and the victim girl has also supported the

Patna High Court CR. MISC. No.64324 of 2019(3) dt.10-12-2019 2/2 prosecution case in her statement recorded u/s 164 Cr.P.C. Having heard both sides, in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.

With the above observations, this application is dismissed.
