The petitioner has been in custody since 09.11.2017 in connection with Mahishi P.S. Case No. 62/2017 registered for the offences punishable under Sections 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that the present petitioner is not named in the First Information Report, but subsequently on the statement made by a co-accused before the police, the name of the petitioner has figured and he has no criminal antecedent. It is further submitted that such statement made before the police has no evidentiary value and there has also been no recovery from his place.
