Mr.Dr. Indiwar Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-10-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Korha P.S. Case No. 81 of 2019 registered under Sections 341, 323, 307, 354, 379, 504 and 506/34 of the Indian Penal Code.

The accusation is that due to land dispute, eight persons named in the F.I.R. including the petitioners came at the door of the informant, Rukmani Devi, and started to abuse. At that time, they started to assault through lathi and danda, in which, her son sustained injury at his head. Thereafter, they also

Patna High Court CR. MISC. No.62365 of 2019(2) dt.16-10-2019 2/2 assaulted the informant and her other family members. In the meantime, they snatched Rs.15,000/- from the pocket of her husband.

Learned counsel for the petitioners submits that petitioners are the next door neighbour of the informant and due to land dispute scuffle took place but the informant lodged the present case with false allegation. Further submissions is that petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Katihar, in connection with Korha P.S. Case No. 81 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
