2. The petitioner apprehends his arrest in a case registered for the offence under Sections 461, 379, 411 and 34 of the Indian Penal Code.
3. As per F.I.R., it is alleged that three unknown persons were committing theft in the shop of informant and on alarm, with the help of other persons, two persons were apprehended and one person succeeded in fleeing away. The apprehended persons disclosed the name of petitioner, as the person, who fled away from the spot.
4. It is submitted on behalf of petitioner that no incriminating article has been recovered from the possession of this petitioner, but only on the basis of confessional statement of apprehended co-accused, this petitioner has been made accused in the case. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Rosera, Samatipur in connection with Bibhutipur P.S. Case No. 192 of 2023, corresponding to G.R. No. 842 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
