The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 420, 468, 471 of the Indian Penal Code and Charge-sheet has been submitted u/s 468, 420, 467, 448, 471, 120(B)/34 of the Indian Penal Code.

As per allegation in the FIR, petitioner has attached forged school leaving certificate to get benefit of juvenile in Cr. Rev. No. 644 of 2021 but after proper enquiry it came to light that his name was not entered

Patna High Court CR. MISC. No.73434 of 2023(2) dt.29-11-2023 2/3 into the admission registered of concerned school. It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is further submitted that statement of the mother of the petitioner has been recorded by the S.I. of Chandauti P.S. in which she stated that no any document was produced by his son. Moreover, the petitioner is languishing in judicial custody since 06.12.2022.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Chandauti P.S. Case No. 439 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each
