04-05-2018 Heard Sri Sanjeev Kumar No. 7, learned counsel assisted by Sri Satyendra Rai, learned counsel for the petitioner and Sri Awadhesh Kumar Singh, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody in Barharia P.S. Case No. 63 of 2015 registered for offence under Sections 341, 323, 324, 307/34 of the Indian Penal Code only since 26-03-2018, has prayed for grant of bail.

Learned counsel for the petitioner submits that earlier, there was general and omnibus allegation, however; subsequently it was alleged, as if, petitioner was the main assailant. He further submits that injury report simply indicates that injury, found on the person of injured, was simple in nature.

No.27070 of 2018(2) dt.04-05-2018 2/2 However, considering the fact that main accusation has been made against the petitioner, at the moment, there is no reason to extend the privilege of bail and as such, the prayer for bail is rejected for the present, with observation that petitioner would be at liberty to renew the prayer for bail after completion of nine months of custody.
