The petitioner apprehends his arrest in connection with Bahadurganj P.S. Case No. 119 of 2019, registered under Sections 341, 323, 307, 354, 379, 504 and 506/34 of the Indian Penal Code.

The accusation is that informant, Tahrun, along with villagers sat on the tempo to return her home. In the way, driver Nahid (petitioner), co-driver Raja and owner of the tempo Ashraf asked to leave the tempo. When the informant made protest then she was assaulted by them. Thereafter, villagers made protest then they also assaulted the villagers. In the meantime, they also snatched silver chain from her neck.

No.62336 of 2019(2) dt.16-10-2019 2/2 Learned counsel for the petitioner submits that at the time of paying of fare, informant started to scuffle with the petitioner, in which, informant sustained slight injury but with ulterior motive, the present case has been lodged with false allegation. Moreover, the injury as found on the person of the informant is simple in nature and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Kishanganj, in connection with Bahadurganj P.S. Case No. 119 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
