Petitioner, apprehends his arrest registered for the offences punishable under Sections 366(A), 504, 506 and 34 of the Indian Penal Code.

Informant is the mother of victim who in her written complaint has stated that on 10.07.2018 at about 6:00 P.M., her minor daughter Puja Kumari went to the shop of petitioner for repair of her mobile and thereafter she did not return and s she came to know that her daughter has been enticed away by the petitioner for purpose of marriage. It has been submitted on behalf of the petitioner that he is innocent and incident is of 10.07.2018 but FIR was

Patna High Court CR. MISC. No.74018 of 2019(3) dt.09-12-2019 2/2 instituted on 26.07.2018. The statement of victim girl was recorded under Section 164 of Cr.P.C. by the Magistrate in which she has stated that she had gone with the petitioner on her own sweet will and volition and she is 18 years old and they have solemnized marriage and living as a husband and wife, however, due to ill health there was no physical relationship between them. Petitioner has no criminal antecedent. Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on prearrest bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, Naugachia, in the District of Bhagalpur in connection with Bihpur P.S. Case No. 301 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
