2. The petitioners have preferred this application for grant of regular bail in connection with Kursela P.S. Case No. 19 of 2025 registered for the offences punishable u/ss 191(2), 191(3), 190, 109, 352, 351(2) of the B.N.S. and Section 27 of the Arms Act.

As per the prosecution case, on 19.01.2025 at about 01:30 P.M., the informant received information from villagers that two groups of miscreants were firing at each other due to rivalry for dominance and a land dispute. For verification of the same, the informant reached there and on seeing the police
Patna High Court CR. MISC. No.70452 of 2025(2) dt.28-11-2025 2/3 party, all the miscreants started fleeing away. On being asked, villagers disclosed the names of miscreants and accordingly, the present F.I.R., has been lodged.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The name of the petitioners was disclosed by local Chowkidar. It is further submitted that no specific allegation of firing is levelled against the petitioners. It is further submitted that in the alleged firing, of the both sides, no one from either side sustained any injury and no empty cartridge was recovered from the place of occurrence. Nothing has been recovered from the conscious possession of the petitioners. The co-accused person has already been granted regular bail by this court vide order dated 27.08.2025 passed in Cr. Misc. No. 59146/2025. The petitioner no. 1 has two criminal antecedents whereas the petitioner no. 2 has one criminal antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 17.06.2025 and 24.06.2025 respectively.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.70452 of 2025(2) dt.28-11-2025 3/3 of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar, in connection with Kursela P.S. Case No. 19 of 2025.
7. The application stands allowed.
