This is an application for regular bail in connection with Chakia P. S. Case No. 253 of 2017 registered for the offences punishable under Sections 385, 287 and 120B of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act. Informant, a police officer, in his self statement has stated that he has received information that at the time of opening of tender of work at Executive Engineer, Chakia, some criminals are going to assemble there to create terror at the instance of one Santosh Singh who is in jail with his associate Kunal Singh. After receiving information he went there and at about 2-30 P.M. tensed situation was created there and petitioner was arrested from that place and from his possession one country made pistol and three live cartridges were recovered from his
Patna High Court Cr.Misc. No.5892 of 2018(3) dt.27-02-2018 2/2 pocket.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case. No recovery was made from his possession and he has got no criminal antecedent. He is in judicial custody since 24.9.2017.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Chakia P.S. Case no. 253 of 2017.
