Petitioner seeks bail in connection with Minapur P.S. Case No. 347 of 2017 registered for the offence punishable under sections 363, 366A/ 34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case due to dirty village politics. It is not a case of kidnapping, rather the victim herself let her home with cash and ornaments. Nothing has been recovered from the possession of this petitioner. Medical board has assessed her age about 16-17 years. Moreover, both the parties have compromised the matter. Victim is ready to get married with the petitioner and they do not want to proceed further in the matter. In this respect, they

No.12204 of 2018(3) dt.04-04-2018 2/2 have filed a compromise petition in the Court below on 12.01.2018. learned counsel has brought on record the certified copy of the petitions filed before the Court below, which is kept on record. Petitioner is a man of clean antecedent, however is rotting in custody since 25.09.2017.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 347 of 2017.
