The petitioner is languishing in custody since 2.8.2019 in a case registered for the offences punishable under Section 394 of the I.P.C.

The prosecution case is that the informant's Thirty Five Thousand Rupees cash, documents, laptop and cheque books were robbed by three miscreants travelling on motorcycle on 10.5.2019, leading to registration of FIR against three unknown. Name of the petitioner sprang up in the confession of coaccused Tahir Ansari. It is submitted by learned counsel for the petitioner that there is no recovery from the possession of the petitioner nor till date the petitioner has not been put on Test Identification

Patna High Court CR. MISC. No.62476 of 2019(2) dt.25-10-2019 2/2 Parade. Statement to that effect has bee made in paragraph 5 of the petition.

Learned APP submits that the name of the petitioner sprang up during investigation.

Considering the fact that neither any recovery has been made from the possession of the petitioner nor he has been put on Test Identification Parade though he is in custody since 2.8.2019 and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Buxar in connection with Buxar (Mufassil) P.S.
