This application for regular bail arises out of Atri P.S. Case No. 318 of 2022 disclosing offence punishable under Section 30(a)(d) of the Bihar Prohibition and Excise Act 2018. It is alleged that 50 litres of mahua liquor, other utensils and articles, used for manufacturing of mahua liquor were recovered from the broken asbestos house of one Santosh Choudhary, where both these petitioners were found present. Learned counsel appearing on behalf of the petitioners have submitted that they have been implicated falsely out of some village politics. The said submission made on behalf of the
Patna High Court CR. MISC. No.67885 of 2022(2) dt.04-03-2023 2/2 petitioners does not convince this Court for the purpose of exercise of discretion by directing their release on regular bail. The petitioner's prayer for bail is accordingly rejected for the present.
The petitioner shall be at liberty to renew his prayer for bail after six months, if, in the meanwhile, there is no substantial progress at the trial.
