The petitioner is apprehending his arrest in connection with Complaint Case No.599C/2018 registered for offences punishable under Sections 323, 379, 498A and 307 of the Indian Penal Code.

Allegation against the petitioner is of demand of Rs.02 lac and ornaments and for non-fulfilment of the demand she was subjected to torture mentally and physically. Petitioner happens to be husband of the complainant.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted and he is still ready to keep her with dignity and care, however, the learned A.P.P. has

Patna High Court CR. MISC. No.62730 of 2019(2) dt.15-10-2019 2/2 opposed the prayer for bail on the ground that the impugned order itself shows that the petitioner has submitted that there is no chance of compromise in this case .

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is at liberty to approach the complainant to reside with him and once she is ready to reside with him, he may appear before the learned court below along with his wife and pray for regular bail, which will be considered by the learned court below .

Considering the above facts, this application is disposed of.
