1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 76, 303(2), 109(1), 352, 351(2), 79, 3(5) and 351(3) of the BNS.
3. Learned counsel appearing on behalf of the petitioner submits that petitioner is a person with clean antecedent and is a senior citizen aged about 65 years and the informant alleges that she had gone to attend the call of nature when Janki Raman came and started acting inappropriately. On alarm, the informant's husband and son came to save her when they were assaulted by the petitioner and Shiv Shankar Singh and further the petitioner assaulted her by sword causing injury on her head.

4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that from the side of the petitioner, Pusa P.S. Case No. 53 of 2025 was instituted against the side of the informant. It is next submitted that no doubt, in the FIR, it is alleged that petitioner assaulted the informant by sword causing injury on the head but then the date of occurrence is 07.05.2025 and the FIR was instituted on 16.05.2025, i.e., after a delay of nine days which casts an aspersion on the case of the prosecution. It is also submitted that had the informant been injured in the manner as alleged in the FIR in that event her fardbeyan would have been recorded at the hospital but then that is not the case. It is reiterated and submitted that petitioner all throughout his life has remained a person with clean antecedent and is not a criminal.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-

No.67372 of 2025(2) dt.07-10-2025 3/3 (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Pusa P.S. Case No. 55 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
