2. The petitioner seeks pre-arrest bail in connection with Shikarpur P.S.Case No.240 of 2025 registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Learned counsel appearing on behalf of the petitioner submitted that the petitioner had been granted prearrest bail, vide order dated 18.06.2025 passed in Cr. Misc. No.36815 of 2025 though the petitioner had not given information regarding his criminal antecedent in Pargraph no.3 of the bail application and at the time of furnishing of the bail bond, it was found that the petitioner was engaged in some other criminal cases. The petitioner filed a fresh bail application giving correct information regarding his criminal antecedent

Patna High Court CR. MISC. No.68808 of 2025(2) dt.26-09-2025 2/2 before the learned district court, however, the learned district court in spite of the fact that this Court has granted pre-arrest bail to the petitioner has rejected the bail application of the petitioner on merit.

4. Learned APP for the State has vehemently opposed the prayed for grant of pre-arrest bail to the petitioner.

Having considered the rival submissions made on behalf of the parties, as well as, considering the fact that 30 ltrs of country-made liquor has been recovered from the sack and the petitioner has now given correct information regarding his criminal antecedent in paragraph no.3 of the present bail application, the petitioner, above named, is directed to be released on pre-arrest bail in connection with Shikarpur P.S.Case No.240 of 2025 on the similar terms and conditions as has been laid down in order dated 18.06.2025 passed in Cr. Misc. No.36815 of 2025.
