This is an application for regular bail in connection with Govindganj P. S. Case No. 60 of 2017 registered for the offences punishable under Section 302 of the Indian Penal Code.
Informant is the brother of the deceased who in his written statement has stated that his elder sister was married to petitioner 25 years ago and out of said wedlock two sons were born. Her husband had gone outside the village for livelihood. On 31.7.2017 he received information from his brother-in-law that his sister has been killed by petitioner. Thereafter, he left for matrimonial house of his sister and found nobody there and the gate was locked. Meanwhile , police also reached there and the house was broke open and it was found that his sister was
Patna High Court Cr.Misc. No.6226 of 2018(3) dt.28-02-2018 2/2 lying dead there due to burn injury.
It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case due to personal grudge. His wife was suffering from mental disease and she used to be treated by Psychiatrist and at the time of occurrence no one was in the house and had gone outside to earn their livelihood. Petitioner has no criminal antecedent. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned ACJM, Ist , East Champaran, Motihari, in connection with Govindganj P. S. Case No. 60 of 2017.
