====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-10-2025 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application for grant of anticipatory bail arises out of Pandarak Police Station Case No. 106 of 2025, disclosing offences under Sections 126(2), 115(2), 109, 3(5) of B.N.S. and Section 27 of Arms Act.

3. The prosecution case, as per the First Information Report is that, on 07.06.2025, in the night, at about 11:00 P:M, while the informant was sitting in the courtyard, the petitioners arrived there, opened fire with country-made rifle and pistol and

Learned Counsel for the petitioners submits that the petitioners have falsely been implicated in this case on account of the fact that on date of occurrence that is on 07.06.2025, around 08:30 P:M, while the petitioner No. 2 was returning after doing accounting work of vehicles, at that time the informant and others brutally assaulted him with sharp weapon and fired two-three rounds for which Pandarak P.S. Case No. 105 of 2025 was lodged by Petitioner No. 2. The FIR lodged by the side of the petitioner is prior in time. Referring to the injury report, at Annexure P/3, learned counsel submits that the injury sustained by the victim is simple in nature.

5. Having regard to the submissions made by the parties and taking into consideration the fact that both the parties are co-villagers, having case and counter case and the injury sustained by victim is simple in nature, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs.

No.69416 of 2025(2) dt.08-10-2025 3/3 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I (Barh), Patna/concerned Court in connection with Pandarak Police Station Case No. 106 of 2025, subject to the condition laid down under Section 482 (2) of the B.N.S.S.
