Petitioner, apprehend his arrest in Ghosi P.S. Case No. 211 of 2019 registered for the offences punishable under Sections 363/365 of the Indian Penal Code.

Informant has alleged that he was married to Sangita Devi and from said wedlock a girl child was born who is aged three and a half years. It is further alleged that his wife on 10.06.2019 along with her daughter fled away with petitioner on his motorcycle.

It is submitted that allegations are false and baseless and alleged occurrence is of 10.06.2019 whereas FIR was instituted on 13.06.2019 and no case under section 363/365 of IPC is made out against petitioner as in the FIR itself Informant has stated that her wife fled away with petitioner as

Patna High Court CR. MISC. No.69777 of 2019(4) dt.24-01-2020 2/2 such no case of kidnapping is made out against the petitioner. Victim is major.

Considering the aforesaid facts and circumstances of the case, provisional bail granted to the petitioner vide order dated 20.11.2019, is hereby confirmed.
