The petitioner apprehends his arrest in connection with Dandari P.S. Case No.56 of 2019 registered under Sections 363 and 366(A)/34 of the Indian Penal Code.

The accusation is of enticing away the daughter of the informant by this petitioner for the purpose of marriage, when she had gone to school.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the petitioner is the co-villager of the informant and, on mere suspicion, the informant disclosed the name of the petitioner as a kidnapper of his daughter. In her statement recorded under Section 164 of the Code of Criminal

Patna High Court CR. MISC. No.62492 of 2019(2) dt.17-10-2019 2/2 Procedure, the daughter of the informant has stated that when she reached at the school, she found the school locked and, all of sudden, she became unconscious and she could not know, who had carried her from there. She has not disclosed the name of the petitioner therein, while the petitioner is her co-villager. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Dandari P.S. Case No.56 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
