The petitioner seeks bail in Excise Case No. 04 of 2018 registered under Sections 30(ka) and 30(gha) of the Bihar Prohibition and Excise Act, 2016.
5 litres of country made liquor and 940 Kg of mahua is said to have been recovered from the sand of the river and the petitioner and two other accused persons managed to escape. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He was not apprehended on the spot. He has been languishing in custody since 08.01.2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Gaya in connection with Excise Case No. 04 of 2018.
