2. Petitioner seeks regular bail in connection with Nagra P. S. Case No. 137 of 2024 in a case registered for the offences punishable under Sections 103(1), 61(2) of the Bharatiya Nyaya Sanhita.
3. As per F.I.R., on 25.11.2024, this petitioner along with co-accused Sachin Kumar called son of the informant from his house and took him away. Later on, his dead body was found lying in the field. Informant suspects that this petitioner and coaccused Sachin Kumar killed her son due to previous enmity, wherein, co-accused Sachin Kumar had threatened the deceased with dire consequences.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.67057 of 2025(3) dt.11-11-2025 2/2 present case is based on circumstantial evidence. Only suspicion has been raised against the petitioner due to the fact that this petitioner was last seen with the deceased along with co-accused Sachin Kumar. During investigation, none of the witnesses have claimed to have seen this petitioner committing the offence or at the place of occurrence. Petitioner claims clean antecedent and he is in custody since 26.11.2024.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation, clean antecedent, materials available on record and period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Saran at Chapra in connection with Nagra P. S. Case No. 137 of 2024.
