JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 08-11-2023 Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Sarairanjan P.S. Case No. 184 of 2023 registered for the offences punishable under Sections-145, 186, 147, 149, 341, 342, 323, 332, 333, 307, 379, 427, 224, 225, 504 of the Indian Penal Code.

Allegedly, on the tip off, the police personnel proceeded to Sarairanjan Dih to inquire about the preparation of illegal country-made liquor and in that course, a person in tipsy

Patna High Court CR. MISC. No.72035 of 2023(2) dt.08-11-2023 2/2 condition, was apprehended. It is further alleged that 50-60 persons unlawfully assembled there and started creating nuisance. The police vehicle was also damaged. Learned counsel for the petitioners has submitted that thy are innocent and have falsely been implicated in the present case. The petitioners are persons of clean antecedent and on exactly similar footing, a number of co-accused persons have been granted bail by a co-ordinate bench of this court vide order dated 11-08-2023 passed in Cr. Misc. No. 49337 of 2023. Learned Additional Public Prosecutor opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Special Judge, (Excise)-2, Samastipur in connection with Sarairanjan P.S. Case No. 184 of 2023, subject to condition as laid down under section 438(2) Cr. P.C. (Nawneet Kumar Pandey, J) A.K.V.//- U T
