The petitioner seeks bail in a case registered under Sections 341, 323, 307, 504, 506/34 of the Indian Penal Code. Allegation is that the accused persons including the petitioner assaulted the informant by means of lathi and danda causing injury on his head.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.08.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case and counter case between the parties. The nature of injury is said to be simple. Hence, no offence under Section 307 of the I.P.C. is made out. The alleged occurrence is said to have taken place

Patna High Court CR. MISC. No.65766 of 2019(2) dt.21-10-2019 2/2 due to petty reason.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Aoungari P.S. case No.59 of 2019.
