24-08-2020 Heard learned counsel for the parties through video conferencing.

In compliance with order dated 26-06-2020, supplementary counter affidavit has been filed on behalf of respondent/Bihar State Construction Corporation Limited (for short "Corporation"), whereby an order of the Division Bench of this Court dated 08-10-2018 passed in Letters Patent Appeal No. 177 of 2018 (in C.W.J.C. No. 2767 of 2011) has been brought on record. On perusal of the same, it appears that the

Patna High Court CWJC No.15676 of 2017(5) dt.24-08-2020 2/2 issue, which is almost same and similar to the present writ petition, has already been decided by the Division Bench. In that view of the matter, this writ petition can be disposed of in light of judgment dated 8.10.2018, pronounced in Letters Patent Appeal No. 177 of 2018 (in C.W.J.C. No. 2767 of 2011) granting liberty to the petitioner, either to intervene in the said proceedings before the respondent/Corporation or to wait for the outcome and then take appropriate steps, in accordance with law before the appropriate forum. It will be open for the petitioner to submit an appropriate application before the competent authority for payment of dues and the competent authority may consider the same in accordance with law, for which, this Court does not express anything in favour of any party.

With above observation & direction, the writ petition stands disposed of.
