2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 126(2), 115(2), 352, 351(2), 96, 3(5) of the B.N.S.

3. The case of the prosecution is that the minor daughter of the informant was kidnapped by the petitioner and other accused persons.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that during investigation, victim was recovered and she has given her statement under Section 183 of the BNS in which she has

Patna High Court CR. MISC. No.71368 of 2024(6) dt.20-02-2025 2/2 stated that she had gone to 'Agartalla' with the petitioner. She has also stated that she has solemnized marriage with the petitioner. Further submission is that from perusal of the medical report, it transpires that the victim has denied for medical examination. Moreover, the petitioner is languishing in judicial custody since 25.07.2024 having no criminal antecedent.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Belhar P.S. Case No. 220 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -6 cum Spl Judge PoCSO, Banka.
