JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-11-2017 The appellant seeks pre arrest bail in connection with Janta Bazar P.S.Case No.86 of 2017 registered for offences punishable under Sections 420, 406, 467, 468 and 471 Indian Penal Code and section 3(1)(r) of SC/ST Act.

Allegation against the appellant is that he had taken huge amount from the informant in the name of providing job at Malasia and thereafter they had gone to Malasia on tourist visa and not on the working visa, as such he has defalcated huge amount from the informant. It is further submitted that the FIR itself shows that they had gone to Malasia and as a matter of fact they had worked there also and now a false and concocted case has been lodged.

Further submission is that the appellant is ready to pay back 50 % of the total amount with condition that it will be subject

Heard learned Special P.P. also.

Let the appellant surrender along with bank draft of 50 % of the total amount and the learned Special Judge being satisfied with the bank draft, shall release the appellant on bail to his own satisfaction. It is also made clear that the aforesaid amount, so deposited, shall be released in favour of the informant but that will be subject to result of the case.

With the above observation, this appeal is disposed of. (Vinod Kumar Sinha, J) chn/- U T
