The petitioner seeks bail in connection with Case No. C2/708/17 for offences punishable under Section-30(A) of Bihar Prohibition and Excise Act, 2016.

The prosecution case as lodged by the SSB officials is that the petitioner was apprehended near Indo-Nepal Border carrying 27 litres of Nepali Sophie wine. Accordingly, seizure memo was prepared.

It has been submitted by the learned counsel for the petitioner that he is innocent, he has no criminal history and he is languishing in judicial custody since 14-12-2017. He submits that

Patna High Court Cr.Misc. No.26175 of 2018 (2) dt.10-05-2018 the prosecution report has not yet been submitted and the petitioner is in custody since nearly five months. However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousands) each, with two sureties of the like amount each to the satisfaction of learned A.D.J.-Ist, Special Judge (Children Court), Sitamarhi in connection with Case No. C2/708/17.
