The petitioner seeks bail in Jhanjharpur P.S. Case No. 64 of 2017 registered under Sections 341, 323, 324, 307, 353, 427, 504 & 506 of the Indian Penal Code.
As per the prosecution case, the petitioner is said to have hurled excreta on the informant and assaulted him by means of knife and lathi and also pressed his scrotum entering into the Advocate Association.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged has taken place. When the petitioner refused to give evidence in favour of the informant in a case i.e. Trial No.129 of 2013, which ultimately ended into
Patna High Court Cr.Misc. No.7416 of 2018 (02) dt.07-02-2018 - 2 - conviction of the informant. The informant falsely implicated her in this case. It is further submitted that such occurrence is not possible at 9 AM at such place as it is crowded place. The injuries sustained by the victim are superficial in nature and the doctor has not opined the nature of injury. All the injuries are on non-vital part. Petitioner is a lady and has been languishing in custody since 29.06.2017.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-I, Jhanjharpur, Madhubani in connection with Jhanjharpur P.S.
