JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 12-04-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Giriyak (Katarisarai) P.S. Case No. 24 of 2018 for the offences punishable under sections 419, 420, 467, 468 and 471 of the I.P.C and section 66 of the I.T. Act.
Allegedly, acting on a tip off the informant raided the place of occurrence with other police personnel and then the accused persons started fleeing away, however one Ranjit Kumar was caught and he stated the names of the petitioners that they
Patna High Court Cr.Misc. No.17377 of 2018 (2) dt.12-04-2018 2/2 succeeded in fleeing away and from possession of Ranjit Kumar mobile and list of customers were recovered.
Submission is of false implication and that nothing has been recovered from possession of the petitioners, due to enmity and local politics their names have been implicated, the petitioners have got no concern with the seized articles, they have got no criminal antecedents and as such they deserve sympathetic consideration.
The learned A.P.P. opposes prayer for pre-arrest bail of the petitioners.
In the facts and circumstances stated above, considering that the names of the petitioners have been taken by the co-accused before police and as such the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M-1st, Biharsharif at Nalanda in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
